Pre-Application Criminal Conviction Clearance Procedure


Any applicant who has had a conviction listed on the Disqualifying Penal Code List will be automatically denied certification. All CNA/HHA applicants should review this list carefully to avoid wasting their time, effort and money by training, testing and submission of fingerprints since they cannot receive the required criminal background clearance if they have been convicted of any of these violations.

Certification of applicants with convictions on the Disqualifying Penal Code list MAY be reconsidered by ATCS only if misdemeanor actions have been dismissed by a court of law or a Certificate of Rehabilitation has been obtained for felony convictions. Any other convictions, other than minor traffic violations, must also be reviewed by ATCS.

In order for an applicant who has a prior conviction listed on the Disqualifying Penal Code to qualify for a reconsideration due to dismissal or certification of rehab, the individual (not Shasta College Health Sciences office) must submit an application for Initial Certification (Form # HS 283 B) and fingerprinting (Live Scan) utilizing DOJs Request for Live Scan (BCII 8016) to initiate a background investigation.  Communication will be directly between the applicant and the Department of Health Services. 

If the conviction prevents certification, the applicant will be notified in writing from the Department of Health Services.  Applicants cannot receive a certification until they have been cleared through a background investigation.

If the applicant is able to obtain clearance for the prior conviction through the Department of Justice, they can apply for the Nurse-Aide/Home Health Aide program.  If the applicant is not granted clearance, they will be ineligible for certification through the Department of Health Services as a nurse aide/home health aide and, therefore, also ineligible for the Nurse Aide/Home Health Aide program.
